Terms of Use
These terms (“Terms”) are an agreement between you and Door Alpha (“Door Alpha”, “we”, “us”) covering your use of the Door Alpha mobile app and the website at dooralpha.app (the “Service”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
1. The Service
Door Alpha helps owners of US residential rental property track their portfolio and model scenarios such as sales, refinancing, 1031 exchanges, depreciation and ownership structures. You must be at least 18 and able to form a binding contract to use it.
2. Estimates, not advice
Figures in the Service — including values, cash flow, depreciation, tax estimates, deadlines and comparisons — are estimates based on the information you enter, simplified models of federal and state tax rules, and third-party data. They may be incomplete, out of date or wrong for your circumstances. In particular, tax estimates do not account for every factor that affects a real return, such as your individual tax bracket, alternative minimum tax, suspended passive losses, local taxes or changes in law.
You are responsible for decisions you make. Do not rely on the Service as a substitute for advice from a CPA, tax attorney, financial adviser or other qualified professional, and verify any deadline (including 1031 exchange deadlines) independently.
3. Your account
Keep your sign-in details confidential and tell us promptly if you believe your account has been accessed without permission. You're responsible for activity under your account. Provide accurate information and keep it up to date.
4. Subscriptions and billing
- Free use. You can track one property without a subscription. Tracking more requires a paid plan.
- Plans. Paid plans are offered monthly or annually and differ by the number of properties you can track. Current prices are shown in the app before you buy.
- Billing. Subscriptions are purchased and billed through the Apple App Store or Google Play and are subject to their terms. Payment is charged to your store account when you confirm the purchase.
- Automatic renewal. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the period ends. Your store account is charged for renewal within the 24 hours before the current period ends.
- Cancelling. Manage or cancel your subscription in your App Store or Google Play account settings. Cancelling stops future renewals; you keep access until the end of the period you've paid for. Deleting the app or your Door Alpha account does not cancel a subscription.
- Refunds. Refunds are handled by Apple or Google under their policies. Where we're required by law to provide a refund, we will.
- Price changes. If prices change, we'll tell you in advance and the store will ask for your consent where required. New prices apply from your next renewal.
- Downgrading. If your plan lapses or you move to a plan with a lower property limit, your existing data is kept but you may not be able to add properties beyond the new limit.
5. Your data
You own the information you enter. You give us a limited licence to host, store, process and display it solely to provide the Service to you, as described in the Privacy Policy. You can export it and delete it at any time.
6. Acceptable use
Don't misuse the Service. In particular, don't: attempt to access other users' data or our systems without permission; interfere with or overload the Service; reverse engineer it except where the law allows; use it for anything unlawful; or resell or commercially exploit it without our written agreement.
7. Third-party services
The Service uses third-party data and services, such as maps, street-level imagery and public house-price indices. We don't control them and aren't responsible for their content or availability. Your use of the App Store or Google Play is governed by Apple's or Google's terms.
8. Changes and availability
We're continually improving the Service and may add, change or remove features. We aim to keep it available but don't guarantee it will be uninterrupted or error-free, and we may suspend it for maintenance or security reasons.
9. Intellectual property
The Service, including its software, design, text and graphics, belongs to Door Alpha or its licensors. These Terms give you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own portfolio, while you comply with these Terms.
10. Ending your use
You can stop using the Service and delete your account at any time. We may suspend or close accounts that breach these Terms or put the Service or other users at risk, and will tell you where appropriate. Sections 2, 5 and 11–14 survive termination.
11. Disclaimers
To the extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of accuracy, fitness for a particular purpose and non-infringement.
12. Limitation of liability
To the extent permitted by law, Door Alpha will not be liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, savings or data, or for any tax, penalty or interest you incur, arising from your use of the Service or reliance on its estimates. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim arose.
Nothing in these Terms limits liability that cannot be limited by law, such as for fraud or for death or personal injury caused by negligence, and nothing affects the statutory rights you have as a consumer.
13. Apple App Store terms
If you downloaded the app from the Apple App Store, you also agree that:
- these Terms are between you and Door Alpha, not Apple, and Door Alpha (not Apple) is solely responsible for the app and its content;
- your licence is limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions;
- Apple has no obligation to provide maintenance or support for the app;
- if the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law Apple has no other warranty obligation for the app;
- Door Alpha, not Apple, is responsible for addressing any claims relating to the app, including product liability, legal or regulatory compliance, consumer protection and intellectual property claims;
- you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and you are not on any U.S. Government list of prohibited or restricted parties; and
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
14. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction. If you live elsewhere, you keep the protection of any mandatory consumer laws of your country or state, and you may bring proceedings in your local courts where those laws allow.
15. Changes to these Terms
We may update these Terms. We'll change the effective date above and, for material changes, notify you in the app or by email before they take effect. Continuing to use the Service after that means you accept the updated Terms.
